1. Controller
OPTIONLESS, owner Marc Etim, Weckhovener Straße 12, 41466 Neuss, Germany, email: info@optionless.de. We have not appointed a data protection officer as there is no legal obligation to do so.
2. Overview
We process personal data only to the extent necessary to operate the shop, process your order, communicate with you or on the basis of your consent. The legal bases are Art. 6(1)(a) (consent), (b) (contract), (c) (legal obligation) and (f) GDPR (legitimate interest).
3. Hosting and shop system
Our shop runs on Shopify. The provider for merchants in the EU is Shopify International Limited, Victoria Buildings, 2nd Floor, 1–2 Haddington Road, Dublin 4, D04 XN32, Ireland. Shopify processes technical data when you visit (e.g. IP address, browser, time, pages viewed) as well as your order data on our behalf. Data may also be transferred to Shopify Inc. in Canada and the USA on the basis of EU adequacy decisions or EU standard contractual clauses. Legal basis: Art. 6(1)(b) and (f) GDPR.
4. Orders and customer account
For your order we process name, billing and shipping address, email address, phone number if provided, ordered items and payment information (Art. 6(1)(b) GDPR). If you create a customer account, we store this data there until you delete the account. Under commercial and tax law we must keep order data for up to ten years (Art. 6(1)(c) GDPR).
5. Payment providers
Depending on the payment method, we pass the data required for payment to the respective provider, e.g. Shopify Payments (credit card, Apple Pay, Google Pay, Shop Pay; processed by Stripe Payments Europe Ltd., Dublin, Ireland), PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, 2449 Luxembourg, or Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. Klarna may transmit data to credit agencies to check your identity and creditworthiness. Legal basis: Art. 6(1)(b) GDPR. The privacy notices of the respective provider also apply.
6. Shipping and tracking
For delivery we pass your name and shipping address to DHL (Deutsche Post AG / DHL Paket GmbH, Sträßchensweg 10, 53113 Bonn, Germany) (Art. 6(1)(b) GDPR). We only pass on your email address if you have consented, so that DHL can notify you about the delivery (Art. 6(1)(a) GDPR). For order tracking in the shop we use the app ParcelPanel, which processes order number and tracking data (Art. 6(1)(b) GDPR).
7. Withdrawal and returns
If you use the "Cancel contract" function, we process order number, postcode, name, email address and your return details to handle the withdrawal and send you a confirmation of receipt (Art. 6(1)(b) and (c) GDPR). For this we use our own system operated by Vercel Inc. (USA); the data is stored in a database of the provider Neon on servers in Frankfurt, and emails are sent via the service Resend (USA). Transfers to the USA are based on the EU-US Data Privacy Framework or EU standard contractual clauses.
8. Newsletter and back-in-stock notifications
If you sign up for the newsletter or ask to be notified when a size is back in stock, we use your email address to send you these emails (Art. 6(1)(a) GDPR). Emails are sent via Shopify Email. You can unsubscribe at any time via the link in every email or by writing to info@optionless.de. If we received your email address in connection with a purchase, we may send you recommendations for similar products of our own (§ 7(3) UWG); you can object at any time without incurring any costs other than the transmission costs at basic rates.
9. Contact
If you contact us by email or contact form, we process your details to handle your request (Art. 6(1)(b) or (f) GDPR) and delete them once they are no longer needed.
10. Product reviews
We use Judge.me for reviews. If you submit a review, your name (or initials) and your review are published. After an order we may ask you for a review by email (Art. 6(1)(f) GDPR); you can object at any time.
11. Cookies and consent
We use technically necessary cookies so that cart, checkout and language settings work (§ 25(2) TDDDG, Art. 6(1)(f) GDPR). We only use analytics and marketing cookies with your consent via the cookie banner (§ 25(1) TDDDG, Art. 6(1)(a) GDPR). You can change your choice at any time via "Cookie settings" in the footer.
12. Analytics and marketing (with consent only)
With your consent we analyse shop usage with Shopify Analytics. Via the Google & YouTube sales channel (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland) we provide product data to Google and may – only with consent – measure conversions.
13. Links to social networks
We link to Instagram, TikTok and our WhatsApp channel. These are simple links; data is only transferred when you click them. The privacy notices of the respective provider then apply.
14. Storage period
We store data only as long as necessary for the respective purpose or as required by statutory retention periods (up to ten years).
15. Your rights
You have the right of access (Art. 15), rectification (Art. 16), erasure (Art. 17), restriction of processing (Art. 18), data portability (Art. 20) and objection (Art. 21 GDPR). You can withdraw any consent given at any time with effect for the future. Just write to info@optionless.de.
16. Right to lodge a complaint
You can lodge a complaint with a data protection supervisory authority, e.g. the State Commissioner for Data Protection and Freedom of Information of North Rhine-Westphalia, Kavalleriestraße 2–4, 40213 Düsseldorf, Germany.
17. Changes
We update this privacy policy when our services or the legal situation change. The current version on this page applies.
